ILLINOIS LAW ON DOG BITES

Illinois law, by virtue of the Illinois Animal Control Act, states that :

“If a dog or other animal, without provocation, attacks or injures any person who is peaceably conducting himself in any place where he may lawfully be, the owner of such dog or other animal is liable in damages to such person for the full amount of the injury sustained.”

Thus, a person injured by a dog may seek compensation for past and future medical expenses; lost income and diminished earning capacity; pain and suffering; emotional distress and other losses related to the bite and injury. Claims can be made against a dog owner or third party and are often times covered by a policy of homeowner’s or renter’s insurance.
