OVERWEIGHT TICKETS AND VIOLATIONS
ILLINOIS LAW ON OVERWEIGHT VIOLATIONS
Under Illinois law, 625 ILCS 5/15-112 and 113 provides for enforcement of overweight trucking violations and fines for said violations. A police officer needs to have a reason to believe that the weight of a vehicle or load is unlawful and he may require the driver to stop and submit to weighing said vehicle.
Overweight violations call for extremely high fines in addition to very high court fines, fees and costs. Overweight violations are so harsh because of the potential damage that heavier trucks cause to roadways around the state of Illinois. Thus, the amount of the mandatory fine is directly related to the amount the vehicle is overweight:
Up to 2,000 pounds - $100.
Between 2001 and 2500 pounds - $270.
Between 2501 to 3000 pounds - $330.
Between 3001 to 3500 pounds - $520.
Between 3501 to 4000 pounds - $600.
Between 4001 to 4500 pounds - $850.
Between 4501 to 5000 pounds - $950.
If the truck is overweight by 5001 or more pounds, the ticket shall be $1500 for the first 5000 pounds over plus $150 for every additional 500 pounds over.
